Terms & Conditions
Please review these terms before purchasing park access, training, rental gear, travel, gift cards, products, or services.
Introduction
These Terms & Conditions apply to purchases, bookings, rentals, training, services, and park access associated with Mammoth Lake Texas, Mammoth Lake Recreation Park, LLC, and Mammoth Dive Academy.
By making a purchase online, by phone, or in person, you acknowledge that you have reviewed and agree to these Terms & Conditions.
Park Access & Facility Use
- Mammoth Lake Texas is a DBA of Mammoth Lake Recreation Park, LLC.
- All guests entering the property must check in, complete required waivers, and follow posted park rules.
- Mammoth Lake Texas is not responsible for loss or damage to personal property.
- Mammoth Lake Texas reserves the right to refuse service or property access to anyone.
- Weather, water conditions, visibility, safety concerns, or other operational issues may affect park access, diving, training, events, or facility use.
Course Bookings
- Training courses are provided through Mammoth Dive Academy.
- Mammoth Dive Academy is not liable for unforeseen circumstances due to weather, including changes or cancellations affecting classes, trips, events, or charters.
- No student may participate in any diving class or activity without completing all required medical statements, liability forms, assumption of risk forms, waivers, and e-learning requirements where applicable.
- If a student does not meet required performance standards during dives or knowledge development, additional training sessions may be required and additional fees may apply.
- Classes are non-refundable and non-transferable. A one-time transfer may be offered for scheduling challenges. After one transfer, additional fees may apply.
- Any unpaid course-related charges may result in suspension of training and withholding of certification until paid in full.
- Courses must be started within 12 months of payment unless prior written agreement is made with Mammoth Dive Academy.
- Students agree to follow the rules, policies, and decisions of Mammoth Dive Academy, its staff, instructors, and subcontractors in all diver-training matters.
Course Learning Agreement
Mammoth Dive Academy training courses are intended to be safe, educational, and enjoyable. Students are expected to study independently as directed by the instructor and complete all required e-learning before classroom, pool, or open water sessions.
- Students must follow all course procedures and instructor directions.
- Students must arrive on time and prepared for all scheduled sessions.
- Students must complete required academics, e-learning, pool work, and open water training.
- Certification is issued only after all course requirements and skill-performance standards are met.
- If a student has not been diving for 12 months or longer, Mammoth Dive Academy may require a skills review before training continues. Additional fees may apply.
Training Orientation
Course orientation may include discussion of:
- Pool and open water locations.
- Emergency procedures and general safety matters.
- Medical fitness to dive.
- Course prerequisites and entry requirements.
- Equipment use, rental fees, and responsibility for lost or damaged equipment.
- Course content, fees, scheduling, cancellations, and possible additional charges.
Equipment Rental Policy
- Rental gear is rented through Mammoth Dive Academy.
- All rentals must be paid in full before equipment leaves the dive center.
- No refunds or credits are issued for non-use of rented equipment.
- All rentals require proof of diving certification and proof of diving activity within the previous 12 months.
- A valid card may be required on file as a security deposit.
- Equipment must be returned clean, dry, working, complete, and on time.
- Failure to return equipment properly may result in forfeiture of security deposit or additional charges.
- Use of rented equipment is at the renter’s own risk unless caused by negligence or breach of duty by Mammoth Dive Academy or its staff.
Travel Bookings
- Travel bookings, trips, and related travel services are arranged through Mammoth Dive Academy unless otherwise stated.
- All rates are subject to change until the applicable accommodation, product, or service is paid in full.
- Rates may change due to taxes, government charges, fare increases, fuel surcharges, vendor changes, or other events outside Mammoth Dive Academy’s control.
- All deposits and payments are non-refundable unless otherwise stated in writing.
- All cancellations must be made in writing by email.
- If Mammoth Dive Academy is able to fill a cancelled spot, a refund may be issued minus a 10% surcharge.
- Payments more than 14 days past due may result in forfeiture of the trip spot with no refund.
- Diver insurance is required. Trip insurance is highly recommended.
- Travel is at your own risk.
- Mammoth Dive Academy is not liable for additional fees, accommodations, delays, interruptions, illness-related costs, or pandemic-related travel issues.
- Mammoth Dive Academy reserves the right to cancel any trip that does not meet the required minimum number of travelers.
If A Travel Vendor Cancels
If a travel vendor such as a charter operator, resort, or other provider cancels and alternate arrangements cannot be made, Mammoth Dive Academy may offer one or more of the following remedies where applicable:
- Apply the current trip balance toward a different trip.
- Issue store credit.
- Issue a full refund.
Gift Card Terms
- Gift card funds do not expire and no fees apply.
- Protect gift cards like cash.
- Lost, stolen, or damaged gift cards may only be replaced if unused and with satisfactory proof of purchase and card information where required by law.
- Mammoth Dive Academy may correct a gift card balance if a clerical, billing, or accounting error occurs.
- Mammoth Dive Academy may deactivate, cancel, or suspend a gift card if fraud, unlawful activity, or improper use is suspected.
- Gift cards are not credit, debit, or charge cards.
Work Orders & Shop Services
- Shop services and work orders are provided through Mammoth Dive Academy.
- You will be notified when your work order is ready for pickup.
- You are responsible for all labor and parts fees associated with shop services.
- Additional parts or labor will be approved before service and will be your responsibility.
- Mammoth Dive Academy is not responsible for damage caused to equipment showing signs of extensive corrosion.
- All serviced equipment must be checked before leaving the store to verify satisfactory service.
- Equipment not picked up after 30 days may incur a storage fee of $25 per week.
- Equipment not picked up within 6 months of completion may be considered abandoned and become property of Mammoth Dive Academy.
- Mammoth Dive Academy is not responsible for unauthorized post-service tampering.
Product Refund Policy
- Products may be returned within 30 days of the original purchase date with proof of purchase for a refund, subject to policy requirements.
- After 30 days, store credit only.
- After 90 days, no refund or exchange will be issued.
- All refunds are subject to a 10% restocking fee.
- Products must be unused, in original packaging, and show no signs of use or wear.
- Customized equipment is not eligible for return or exchange.
